Foreword

The intention of this document is primarily to advise the browser or user that the content of the above website is, for the most part, protected under laws of copyright and is – with certain exceptions – the intellectual property of a specified organization, legal entity, or person/s. In this connection, a user is limited to "fair use" of any item on the website, as defined under law and below and all related enquiries may be directed to pedagog@jajz-ed.org.il .

Furthermore, while the website owners and producers make every effort to ensure the quality of the content of the website, this document sets out the limitations of their legal liability for such content, or for links placed from the website to external websites.

Terms and Conditions

The Jewish Agency for Israel (hereinafter: "The Jewish Agency", "The Agency" or "JAFI", as well as "The World Zionist Organization", and " the WZO") has made information and resources (heerinafter known as: "(online) resources", "content", "information", "tools" ) available on its Internet website (hereinafter known as: the "service", "page/s", or "website").

Accessing any of these webpages is deemed to be use (or usage) of the service and shall be considered to be made in good faith, in agreement with and subject to the terms and conditions below.
Such person(s) accessing the website shall be termed "users", or "browsers", whether entering the website directly, or from an external link, and the terms and conditions of use are identical.

1A: Copyright and Intellectual Property

In accordance with current Israeli legislation and under international treaties, accords or agreements, concerning Intellectual Property, any publication under the auspices of the Jewish Agency is declared copyright to the Agency, whether offline, or on the Agency website, with the exception of such publications that are accredited to other sources and copyright holders (third party sources), with their appropriate permission, or of those belonging to the Public Domain.

These rights to Intellectual Property do and shall be deemed to extend to all items and media on the service, whether textual content, graphic design, illustrations, images, maps, collections of links, audio resources, video resources, tools or applications related to software, that have been developed for, or under, these auspices, with the exception of those that are accredited to third party sources, or of those belonging to the Public Domain.
As such, this is protected material under Copyright law, and shall be termed such, for the purposes of any usage.

1B: Fair Use

The user is entitled to make "fair use" of these protected materials, under the following rules, in accordance with the requirements of law and use of the website constitutes agreement to the following rules and conditions:

1. Fair use shall be considered to be a reasonable quotation from a page or resource, together with print-out for personal use.
2. In any such quotation or personal print-out of protected material from the Agency website, the direct source and full credits shall appear on the page, with the designation ©.
3. The user is not authorised to and may not alter or change the content or context of such resources, or pages, as they appear on the website; furthermore, it is prohibited to make use of a resource in a manner which detracts from the value of the protected material, or which may be to the detriment of the standing or bring into disrepute the name of the copyright holder, i.e. the Jewish Agency or others.
4. In accordance with the laws on Intellectual Property, the user is prohibited from and agrees not to engage in copying, reproducing, disseminating, distributing, transmitting, re-publishing, selling, or storing these protected materials in any form, electronic (digital, graphic) or conventional (bound or unbound printing, photographic, photocopy, graphic, or other), without the express and advance permission of the Agency.
5. Educational users shall be bound by the same conditions as general users, with the proviso that the Agency's partner organizations may make unbound print copies for the personal use of students and participants, in accordance with the provisions above, and that such second-level users shall be bound by the same provisions of Copyright and Fair Use.

2: Liability Disclaimer

The service, the information and the content are offered to the public or any user "As Is", and in good faith, but the Agency shall bear no responsibility of any manner in this respect.

Use of the website shall constitute agreement to the following conditions and terms:

1. The Agency shall not bear any responsibility for the suitability of this service to the user's needs.
2. The user is solely responsible for checking the reliability of website content before using it or for any use he or she may make of such content, and this responsibility and liability do not devolve upon the Agency.
   2a. The Agency shall not bear any responsibility for any damage to a user arising from the service; nor to any third party, whether the damage shall be as a direct or indirect result of using the service; and including any damage arising from reliance on the content appearing on the website; nor from any defects or interruptions in normal service, whether of transmission or of content, whether accidental or by a third party.
   2b. The Agency shall not bear any liability for errors or omissions in the resources presented on the website or for any changes made to such resources on the service by the user or any third party whomsoever. The user shall be solely responsible for verification of such resources and for the manner in which he or she uses the service.
3. For the purposes of the Liability Disclaimer, the term "Agency" shall also refer to the former and current employees, directors, associates and representatives of the Jewish Agency for Israel and the World Zionist Organization, or any person authorised to act on its behalf, as well as any third party whose information appears on the website by agreement.

3: Links – Terms of Use and Liability Disclaimer

The service includes Links to other websites and pages. The following conditions apply to the use of such links, and do not in any way detract from the validity of the general Terms and Conditions of Use herein:

1. These links are intended solely for the user's convenience and further information. Unless otherwise stated, the Agency has no control or rights over the content to be found on such websites and shall not be liable in manner whatsoever for their use, which is at the sole liability of the user.
2. The existence or publication of these links to an external or third party website or page does not constitute endorsement, or preference by the Jewish Agency for such linked websites, opinions expressed on them, nor of their documents, or of any other resources or links which may appear on them, nor of the owners or operators of such websites, nor of any products that appear on them.
3. The existence or publication of links to other pages or websites do not constitute an advertisement of their products, offers, or resources, or advertisement for sale.

4: Validity of Information – Terms of Use and Liability Disclaimer

The information on this service is not intended to amend any legislation or legal provision, regulation, ordinance, rulings, or other legally binding provisions, or official information that has been published at large.

1. The user hereby agrees that the said information in the said service shall not constitute any legal basis for any form of claim in law, in any sphere or setting and that he or she has no right to rely on this information in order to base any such claim.
2. The user is cautioned hereby that he or she has no right to make deleterious use the information and services offered on or through the website. Furthermore, the user is cautioned hereby that any damage to the Jewish Agency or to a third party through fabricated information, whether accidental or willful, and in any manner, that originated from the user, shall be the sole legal liability of the user.

5: Other Conditions of Use

1. The Agency reserves the right to modify, revise or withdraw any protected or public information, or tools, from the service as it deems fit, without prior notice and without any liability to any third party whatsoever.
2. The Agency may restrict access to any part of the website, as it deems fit, without prior notice and without any liability to any third party whatsoever.
3. The Agency has the right to protect its service and may bar a user from the service, without prior notice, explanation, or any liability under law.
4. Any matter arising from the use or services on the website shall be referred to the Legal Department of the Agency and adjudicated in the competent Israeli Court of Law.
5. The Agency will take action against users whom it believes have violated the Terms and Conditions of use, in order to protect its service and content, pursuant to the above terms and conditions. It will do so within Israeli jurisdiction, and on the basis of Israeli Law and international agreements, without prejudice to its options of pursuing any such claim in the Courts of another country.
